The H-1B Visa: A Pathway for Skilled Professionals in the United States

The H-1B visa serves as a work permit which enables foreign workers to perform their jobs in the United States while they remain non-immigrant status. The visa mainly serves "specialty occupations" which require specialist skills that need at least a bachelor's degree to perform. The fields that qualify for an H-1B visa include IT, engineering, healthcare, finance and scientific research. The H-1B visa allows U.S. companies to solve their workforce shortages by hiring highly trained professionals who possess specific skills from different countries.

The typical duration of an H-1B visa is three years but it allows extensions which total up to six years. The H-1B visa provides a dual-intent benefit because its holders can apply for permanent residency while working in the United States. The H-1B application procedure requires employers to submit petitions on behalf of their staff because the system employs a lottery system to manage H-1B applications which exceed available visas each year.

The H-1B visa presents multiple advantages to users but its implementation contains built-in drawbacks. The lottery system introduces elements of unpredictability which affect applicants seeking H-1B visas. The H-1B holder requires complete support from his or her employer for every aspect of his or her visa. An H-1B holder who loses his or her job will face difficulties maintaining his or her permanent resident status. The H-1B visa program has established multiple restrictions.
